Abstract
En el presente ensayo, se realiza un análisis descriptivo sobre el impacto que ha dejado la implementación del nuevo Impuesto sobre la Renta para la equidad – CREE, implementado mediante la reforma tributaria (Ley 1607/12), enfocado en el principal objetivo, la generación de empleo. El Impuesto sobre la Renta a la Equidad – CREE trajo reformas directamente implicadas sobre las utilidades de las empresas, combinando gran parte de la carga tributaria, afectando diferentes sectores creadores de empleo los cuales constituyen la iniciativa de formalización como son la industria, la minería, la agricultura y el sector financiero. Por otra parte, es importante resaltar que han existido legislaciones como: La Ley 50 de 1990, la Ley 789 de 2002 y la Ley 1429 de 2010 entre otras, que han buscado de cierta forma la disminución en las obligaciones laborales del empleador para el fomento en la generación de empleo. En la constitución de Colombia están consagrados los principios de equidad, eficiencia y progresividad, los cuales en las diferentes modificaciones de las reformas tributarias no se han tenido en cuenta y tampoco han logrado ser el instrumento que se necesita para lograr disminuir el desempleo en el país. Un claro ejemplo de esto es la ley 1607 de 2012, reforma tributaria que afectó la formalidad del empleo para las grandes sociedades que se beneficiaron de la disminución de los pagos de los parafiscales del Sena, el ICBF y la seguridad social de sus empleados, pero les generó un mayor recargo tributario en cuanto al Impuesto sobre la Renta, afectando la generación del empleo.

The following essay conducts a descriptive analysis on the impact resulting from the implementation of the new Income Tax for Equality - CREE, made effective under the tax reform (Law 1607/12) - which is focused primarily on employment generation. The Income Tax for Equality - CREE - brought forth reforms directly impacting corporate profits, affecting the income tax responsibilities and thus influencing different employment-generating sectors driving "formalization" initiatives such as manufacturing, mining, agriculture and financial sectors. On the other hand, it's important to highlight the existence of other legislation’s such as: Law 50 from 1990, Law 789 from 2002, and Law 1429 from 2010 among others that have in their own way sought to reduce the labor obligations of employers in order to stimulate employment generation. The Colombia constitution upholds the principles of equality, efficiency and progressiveness, which previous tax reforms have not been taken into account - nor have they been effective instruments to achieve what is needed to reduce unemployment in the country. A clear example of this is Law 1607 from 2012, a tax reform that affected the "formality" of employment for a large section of society that benefited from the reduction of tax payments for SENA, ICBF and social security for its employees - but which ultimately generated a higher tax burden in terms of the overall Income Tax, which impacted employment generation.
