Resumo
En este trabajo se sistematizaron las normas de procedimiento de las víctimas en la JEP, para lograrlo, se identificaron con la palabra clave “víctima”, se analizaron parafraseándolas o citándolas. Las normas que fueron identificadas son: 1. El Acuerdo Final de 2016; 2. La Ley 1820 de 2016; 3. El Acto Legislativo 1 de 2017; 4. La Ley 1957 de 2019; 5. El Acuerdo 001 de 2018 y 6. La Ley 1922 de 2018; misma normatividad que sirvió para desarrollar la investigación. Se tomaron las normas de procedimiento relacionadas con las víctimas del Acuerdo Final de 2016, que trata de los órganos de la JEP y sus procedimientos; la Ley 1820 de 2016, sobre la amnistía e indulto y el compromiso de los comparecientes con las víctimas; el Acto Legislativo 1 de 2017, que incorpora las normas constitucionales transitorias, la participación de las víctimas y cómo pueden obtener verdad, justicia, reparación integral y no repetición. La Ley 1957 de 2019, en relación con el derecho de las víctimas a la gratuidad, el enfoque étnico y cultural, acompañamiento psicológico y jurídico. El Acuerdo 001, en referencia al principio de centralidad de las víctimas, su participación efectiva, la justicia de los pueblos étnicos; la justicia prospectiva y, finalmente, la Ley 1922 de 2018, por la cual se reglamenta la participación de las víctimas, de los sujetos procesales y de los intervinientes especiales. Asimismo, también se regulan los informes, las medidas cautelares, el procedimiento dialógico, el enfoque étnico racial entre otros temas. En conclusión, la JEP es un tribunal que propugna por garantizar el derecho a la verdad, justicia, reparación inmaterial y las garantías de no repetición a las víctimas.

In this work, the procedural norms of the victims in the JEP were systematized, to achieve this, they were identified with the keyword “victim”, they were analyzed by paraphrasing or citing them. The standards that were identified are: 1. The Final Agreement of 2016; 2. Law 1820 of 2016; 3. Legislative Act 1 of 2017; 4. Law 1957 of 2019; 5. Agreement 001 of 2018 and 6. Law 1922 of 2018; those norms were used to develop the investigation. The procedural norms related to the victims of the Final Agreement of 2016 were adopted, which is about of the JEP and their procedures; Law 1820 of 2016in reference amnesty and pardon and the commitment of those appearing to the victims; Legislative Act 1 of 2017, which incorporates the transitory constitutional norms, the participation of the victims and how they can obtain truth, justice, comprehensive reparation and non-repetition. Law 1957 of 2019, in relation with the rights of victims to gratuity, the ethnic and cultural approach, psychological and legal support. Agreement 001, concerningto the principle of centrality of the victims, their effective participation, the justice of the ethnic peoples; prospective justice and, finally, Law 1922 of 2018, which regulates the participation of victims, procedural subjects and special interveners. Likewise, reports, precautionary measures, dialogic procedure, ethnic-racial focus, among other issues, are also regulated. In conclusion, the JEP is a court that advocates to guarantee the rights to truth, justice, non-pecuniary reparation and the guarantees of non-repetition in favor to the victims.
