Sobre la aplicación de la justicia restaurativa en escenarios de posconflicto para casos de violencia sexual contra el género femenino: lecciones aprendidas del contexto colombiano

ntroducción La violencia sexual es uno de los delitos más gravosos que transcurren dentro de la categoría de violencia contra el género femenino ; y aunque el género masculino también es susceptible de ser víctima de violación o de otros actos que pueden estar incluidos bajo el abanico de posibilidades de la violencia sexual, para efectos de este trabajo de investigación, es preciso limitarlo al concepto de violencia sexual contra el género femenino , entendiendo que, “cuando se trata de ellas verdaderamente es mucho más sanguinaria” (Prado, 2017). Comenta la Relatora Especial sobre la Violencia contra la Mujer, que “la violencia sexual es uno de los crímenes aborrecibles que debe conmover la conciencia de la humanidad, debido a que mujeres y niñas —en diversas partes del mundo—, sistemáticamente continúan siendo víctimas de violación sexual con una brutalidad inconcebible” (Relatora Especial sobre la Violencia contra la Mujer en Consejo Económico y Social de las Naciones Unidas, 2001, p. 20). Ahora bien, la violencia sexual en contextos de conflictos armados se manifiesta de manera espontánea y puntual, o como un método de guerra, donde la sistematización y con un objetivo estratégico de control sobre la población o el territorio, se sincroniza con las fases de preconflicto, escalamiento del conflicto y posconflicto; igualmente esta forma de abuso rompe tabúes violando reglas y cruzando marcos que la sociedad ha establecido como conductas aceptables (Marrit, 2016). Como ejemplo de lo anterior, el marco de conflicto armado en Colombia se reviste de protagonismo en la presente investigación, y es que, según el Auto 092 de 2008 proferido por la Corte Constitucional, las mujeres en este escenario están expuestas a diez (10) riesgos de género y de los cuales se destacan entre otros, la violencia sexual, la explotación o el abuso sexual. Evidencia de ello es que, desde el año 1985 al 2017, “más de 17.669 colombianas han sido víctimas de este flagelo. (…) todos los actores armados han acudido a este tipo de agresión como forma de imponer terror y desvertebrar el tejido social y las vidas de las mujeres” (Corporación Sisma Mujer, 2017). Por ello, y con ánimo de tomar medidas legales para darle un tratamiento a este tipo de agresiones, el Estado colombiano, adoptó entre varias, dos normativas que particularmente resultan de especial atención para esta investigación, toda vez que persiguen un mismo objetivo: lograr la consecución de la paz nacional a través de una justicia restaurativa que salvaguarde el derecho a la verdad y la reparación integral; siendo la primera, la Ley 975 de 2005 o también llamada, Ley de Justicia y Paz, cuyo objeto es facilitar los procesos de paz y la reincorporación individual o colectiva a la vida civil de miembros de grupos armados al margen de la ley, garantizando los derechos de las víctimas a la verdad, la justicia y la reparación (artículo 1); y la segunda, el Acuerdo Final para la Terminación del Conflicto y la Construcción de una Paz Estable y Duradera- en adelante Acuerdo Final de Paz- entre el Estado colombiano y las Fuerzas Armadas Revolucionarias de Colombia, Ejercito del Pueblo —en adelante FARC-EP—, el cual pone en marcha un Sistema Integral de Verdad, Justicia, Reparación y No Repetición, ubicando en el centro a las víctimas como sujetos de derechos, merecedoras de reparación integral y de acceso a la verdad, distanciándose de la acostumbrada justicia retributiva . Por consiguiente, el panorama de aplicación de la justicia restaurativa que reúne el derecho a la verdad y la reparación integral a las mujeres víctimas de violencia sexual merece ser estudiado y abordado, con el fin de aportar una mirada general y valiosa para continuar generando esfuerzos que le apunten a la construcción de la paz y de garantías de no repetición. Para lograrlo, el presente trabajo se centra en resolver la siguiente pregunta de investigación: ¿Qué lecciones aprendidas se pueden identificar en relación con la aplicación de la justicia restaurativa para casos de violencia sexual contra el género femenino en ocasión de la Ley 975 de 2005 y el Acuerdo Final de Paz? Al respecto, el objetivo general es, identificar las lecciones aprendidas derivadas de la justicia restaurativa aplicada en la Ley 975 de 2005 y el Acuerdo Final de Paz para casos de violencia sexual contra el género femenino. A su vez, los objetivos específicos se centran en: • Establecer un marco de referencia teórico y conceptual para entender las nociones de violencia sexual en el género femenino, justicia restaurativa, derecho a la verdad y reparación integral en escenarios de conflicto armado; • Analizar la gravedad del delito de violencia sexual contra el género femenino en el contexto del conflicto armado colombiano; • Exponer los principales aportes de la Ley 975 de 2005 y el Acuerdo Final de Paz en aplicación de la justicia restaurativa para los casos de violencia sexual contra el género femenino.

As an example of the foregoing, the framework of the armed conflict in Colombia plays a leading role in this investigation, and it is that, according to Order 092 of 2008 issued by the Constitutional Court, women in this scenario are exposed to ten (10) gender risks and of which, among others, sexual violence, exploitation or sexual abuse stand out. Therefore, and with the intention of taking legal measures to treat this type of aggression, the Colombian State, among several, adopted two regulations that are particularly of special attention for this investigation, since they pursue the same objective: to achieve the achievement of national peace through restorative justice that safeguards the right to truth and comprehensive reparation; The first being Law 975 of 2005 or also called the Law of Justice and Peace, the purpose of which is to facilitate peace processes and the individual or collective reincorporation into civil life of members of armed groups outside the law, guaranteeing the victims' rights to truth, justice and reparation (article 1); and the second, the Final Agreement for the Termination of the Conflict and the Construction of a Stable and Lasting Peace - hereinafter Final Peace Agreement - between the Colombian State and the Revolutionary Armed Forces of Colombia, the People's Army - hereinafter FARC-EP -, which sets in motion a Comprehensive System of Truth, Justice, Reparation and Non-Repetition, placing victims at the center as subjects of rights, deserving of integral reparation and access to the truth, distancing themselves from the customary retributive justice. Consequently, the panorama of the application of restorative justice that brings together the right to truth and comprehensive reparation for women victims of sexual violence deserves to be studied and addressed, in order to provide a general and valuable perspective to continue generating efforts that they point to the construction of peace and guarantees of non-repetition. To achieve this, this work focuses on solving the following research question: What lessons learned can be identified in relation to the application of restorative justice for cases of sexual violence against the female gender on the occasion of Law 975 of 2005 and the Final Peace Agreement? In this regard, the general objective is to identify the lessons learned derived from the restorative justice applied in Law 975 of 2005 and the Final Peace Agreement for cases of sexual violence against women. In turn, the specific objectives focus on: • Establish a theoretical and conceptual reference framework to understand the notions of sexual violence against women, restorative justice, the right to the truth and comprehensive reparation in armed conflict settings; • Analyze the seriousness of the crime of sexual violence against the female gender in the context of the Colombian armed conflict; • Present the main contributions of Law 975 of 2005 and the Final Peace Agreement in the application of restorative justice for cases of sexual violence against women.
