| dc.description.abstract | El funcionamiento de robots con inteligencia artificial (IA) trae retos para la institución jurídica de la responsabilidad civil como se ha concebido hasta ahora; la capacidad de aprendizaje de la máquina y cierta autonomía que puede adquirir en su desempeño pareciera, en ciertas circunstancias, alejarse del control de un ser humano determinado, lo cual genera dudas sobre quién debe asumir en su patrimonio los daños que eventualmente se causen a terceros. Algunos conceptos tradicionales de la imputación de responsabilidad civil y del Estado reportan utilidad como instrumentos o caminos de análisis para las situaciones que pueden presentarse, según se pretende evidenciar en este trabajo; es decir, el conocimiento actual es útil y no hay que partir de cero. Pero quedan ciertos vacíos que se identifican, para los cuales se necesitarán nuevos planteamientos y otras alternativas de regulación. | |
| dc.description.abstractenglish | The operation of robots with artificial intelligence (AI) presents challenges to the legal institution of civil liability as it has been conceived until now. The machine's learning capacity and the degree of autonomy it can acquire in its performance seem, in certain circumstances, to move away from the control of any given human being, raising doubts about who should bear the costs of any damages that may be caused to third parties. Some traditional concepts of the attribution of civil liability and the State prove useful as tools or avenues of analysis for the situations that may arise, as this work intends to demonstrate; that is, current knowledge is useful, and it is not necessary to start from scratch. However, certain gaps remain, which will require new approaches and other regulatory alternatives. | |
