Hacia un derecho al debido proceso tecnológico

dc.description.abstract	En este trabajo se realiza un análisis de dos fenómenos que están afectando a nuestra justicia, la digitalización y la implementación de herramientas de Inteligencia Artificial, con el objetivo de demostrar la necesidad de un derecho al debido proceso tecnológico. El artículo comienza con una descripción de las tecnologías digitales y con un examen del proceso de implementación de las mismas en la justicia. Tras ello, se proponen tres criterios de clasificación de las herramientas algorítmico-jurídicas que están afectando al proceso, a saber: según su finalidad, según su función y según su diseño tecnológico. En el punto tercero se constatará la falta, hasta el momento, de propuestas para hacer frente a esta realidad por la vía de un nuevo diseño del derecho al debido proceso. Por tanto, se termina con la siguiente conclusión: la urgencia de adaptar el debido proceso a la realidad tecnológica a través del derecho al debido proceso tecnológico.
dc.description.abstractenglish	This paper analyzes two phenomena affecting our justice system: digitization and the implementation of Artificial Intelligence tools. Its aim is to demonstrate the need for a right to due process in the context of technology. The article begins with a description of digital technologies and an examination of their implementation within the justice system. Following this, three criteria are proposed for classifying the algorithmic-legal tools impacting the legal process: their purpose, their function, and their technological design. The third point highlights the current lack of proposals to address this reality through a redesign of the right to due process. Therefore, the article concludes with the following: the urgent need to adapt due process to technological realities through the right to due process in the context of technology.
