Caracterización de la evolución del concepto de derecho a la salud en Colombia a través de los documentos oficiales de la Corte Constitucional y el Ministerio de Salud y Protección Social 1991-2017 - Un análisis de contenido mediante conteo de palabras asistido por robot

Abstract
El sistema de salud colombiano presenta un incumplimiento sistemático de las garantías del derecho fundamental a la salud, dado por el gran número de negaciones de servicios, quejas e interposición de mecanismos de protección como la tutela, a pesar de la consagración de este derecho como un derecho fundamental autónomo. En este ámbito de discusión se observó un distanciamiento de los discursos de la Corte Constitucional de Colombia y el Ministerio de Salud y Protección Social, por lo que se planteó la pregunta: ¿Cuál ha sido la evolución del concepto de garantía del derecho fundamental a la salud en Colombia, de 1991 a 2017?
El objetivo del trabajo consistió en determinar la evolución constitutiva del concepto derecho a la salud en los documentos oficiales de la Corte Constitucional y el Ministerio de Salud y Protección Social. Para ello, el estudio realizó un análisis retrospectivo de revisión documental, mediante el conteo de palabras asistido por robot, bajo el criterio de lenguaje profesional, al cual se le aplicó conteo de palabras para establecer frecuencias de conceptos relacionados con el derecho a la salud, los tipos de violación del derecho y de las problemáticas de política pública identificadas durante la vigencia del estudio.
Los resultados arrojaron 5000 documentos durante el período estudiado, de los cuales, mediante la aplicación de indicadores de densidad, se depuraron hasta obtener 220 documentos y, finalmente, 108 para revisión manual de las expresiones y conceptos relativos al derecho a la salud (87 de la Corte Constitucional y 18 del Ministerio de Salud y Protección Social), siendo evidente el distanciamiento cuantitativo y temporal entre los contenidos relativos al concepto de derecho a la salud entre las dos instituciones, y que el principal motivo del desarrollo jurisprudencial del derecho a la salud en Colombia, fue la tutela.

The Colombian health system presents a systematic breach of the guarantees of the fundamental right to health, given by the large number of denials of services, complaints and the filing of protection mechanisms such as guardianship, despite the consecration of this right as a autonomous fundamental right. In this area of discussion, a distancing was observed from the discourses of the Constitutional Court of Colombia and the Ministry of Health and Social Protection, which led to the question: What has been the evolution of the concept of guaranteeing the fundamental right to health in Colombia, from 1991 to 2017? The objective of the work was to determine the constitutive evolution of the concept of the right to health in the official documents of the Constitutional Court and the Ministry of Health and Social Protection. In order to do this, the study carried out a retrospective analysis of documentary review, through robot-assisted word counting, under the professional language criteria, to which word counting was applied to establish frequencies of concepts related to the right to health, the types of violation of the law and the public policy problems identified during the validity of the study.
The results yielded 5000 documents during the period studied, of which, through the application of density indicators, they were refined until 220 documents were obtained and, finally, 108 for manual review of the expressions and concepts related to the right to health (87 from the Constitutional Court and 18 from the Ministry of Health and Social Protection), being evident the quantitative and temporal distance between the contents related to the concept of the right to health between the two institutions, and that the main reason for the jurisprudential development of the health care in Colombia, was the guardianship.
